Helpr ("Helpr", "we", "us", "our") operates an online platform (the "Platform") that connects individuals and families seeking household services ("Customers") with independent service providers offering cleaning, babysitting, handyman, and related household services ("Helprs"). These Terms of Service ("Terms") govern use of the Platform by both Customers and Helprs during the private beta period and beyond, unless replaced by a later version.
By signing up, browsing, booking, or providing services through the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
This is the most important section of these Terms and governs everything else below.
Helpr operates a marketplace that connects Customers and Helprs. Helpr is not a party to, and does not perform, any cleaning, babysitting, handyman, or other household service.
The service contract for each booking is formed directly between the Customer and the Helpr. Helpr is not the supplier of the service for the purposes of the Australian Consumer Law (ACL) or any other law.
Helprs are independent contractors, not employees, agents, partners, or representatives of Helpr. Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between Helpr and any Helpr user.
Helpr does not guarantee the quality, safety, timeliness, or outcome of any service performed by a Helpr. Helpr's role is limited to identity/background verification (where stated), facilitating bookings, processing payment, and providing a review system.
Helpr operates a standardised pricing model. Prices for each service category are set or published by Helpr. Jobs are posted to available Helprs and allocated on a first-to-accept basis.
Helpr may vary standardised rates from time to time and will publish current rates on the Platform.
Helpr is designed so that Helprs operate as genuine independent contractors, in control of their own work.
Customers may cancel a booking in accordance with the cancellation window published on the Platform at the time of booking. Cancellations outside this window may incur a fee, payable to the Helpr.
Helprs who repeatedly cancel confirmed bookings without reasonable cause may be subject to review and, in serious or repeated cases, deactivation under Section 12.
Refund requests are assessed on a case-by-case basis. This does not limit a Customer's rights under the Australian Consumer Law.
Where a Customer acquires services for personal, domestic, or household use, statutory consumer guarantees under the Australian Consumer Law apply to the service supplied by the Helpr — including that services will be provided with due care and skill, be fit for purpose, and be supplied within a reasonable time. These guarantees cannot be excluded by these Terms.
Because Helpr is not the supplier of the underlying service (see Section 2), these guarantees are owed by the Helpr to the Customer, not by Helpr the Platform. Helpr will nonetheless provide a dispute-support process to help Customers and Helprs resolve service issues.
Helprs are strongly encouraged, and may be required as a condition of listing certain service categories, to hold current public liability insurance.
Details of any platform-level insurance held by Helpr will be published on the Platform once confirmed. This section will be updated prior to full launch.
Helpr may conduct or require background checks, identity verification, and (for babysitting) WWCC verification as a condition of a Helpr profile going live.
Helpr does not guarantee that any check is fully accurate or up to date, and Customers should exercise their own judgment, particularly for services involving children or access to the home.
Users must report any safety concerns, incidents, or suspected misconduct to Helpr immediately at hello@findahelpr.com.au.
Helpr is not a party to the contract between Customer and Helpr and is not responsible for resolving service disputes between them. Helpr may, at its discretion, provide a support process to assist users in reaching resolution, but is not obliged to arbitrate.
Helpr may suspend or deactivate a user's account for breach of these Terms, safety concerns, fraud, repeated cancellations, or poor conduct. Where a Helpr's account is deactivated, Helpr will, in accordance with the Digital Labour Platform Deactivation Code:
To the maximum extent permitted by law, Helpr excludes all liability for loss or damage arising from services performed by a Helpr, including property damage, personal injury, or dissatisfaction with a service, except where such liability arises directly from Helpr's own negligence. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.
Helpr's collection, use, and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms.
Helpr may update these Terms from time to time, including as the Platform moves from private beta to full launch. Material changes will be notified to users via email or in-platform notice. Continued use of the Platform after changes take effect constitutes acceptance.
These Terms are governed by the laws of Australia, and users submit to the non-exclusive jurisdiction of its courts.
